General Conditions of Sales Biscuiterie Astruc


ARTICLE ONE - Scope of application

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by Biscuiterie Astruc, to non-professional buyers wishing to acquire the products offered for sale on the site: eboutique.astruc.fr .

These conditions apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.

These General Conditions of Sale are accessible at any time on this website and will prevail, where applicable, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded by Biscuiterie Astruc constitutes proof of all transactions.

The products presented on this website: eboutique.astruc.fr. are offered for sale for the following country: Metropolitan France

Product offers are within the limits of available stocks. Information on product availability is provided at the time the order is placed.

Modifications to these General Conditions of Sale are binding on users of the site from the time they are put online and cannot apply to transactions previously concluded.

Validation of the order by the Buyer constitutes unreserved acceptance of these General Conditions of Sale. All validated orders cannot be canceled because our products are made to order and they are perishable goods.

ARTICLE 2 - Orders

It is up to the Buyer to select the products he wishes to order on the site, according to the following terms. The Buyer adds all the chosen items to their basket. A shopping cart is like a supermarket shopping cart. The Buyer can therefore add, modify or delete products at any time. He can also abandon his basket.
When the Buyer has completed his purchases, he clicks on "Proceed to payment" in order to summarize his order and then pay.

The sale will only be considered final after confirmation of acceptance of the order by the Seller has been sent to the Buyer, by email or text message. All validated orders cannot be canceled because our products are made to order and they are perishable goods.

In the event of cancellation of the order by the Customer after its acceptance by the Service Provider, for any reason whatsoever other than force majeure, the amount paid for the order, as defined in the article “Payment Conditions” herein. General Conditions of Sale will be automatically acquired by the Seller and will not give rise to any reimbursement.

ARTICLE 3 - Prices

The products are supplied at the current prices appearing on the site, when the order is registered, by Biscuiterie Astruc. Prices are expressed in Euros, including tax.

These prices are firm and cannot be revised during their period of validity, as indicated on the site: eboutique.astruc.fr. They do not include processing, shipping, transport and delivery costs, which are charged extra.

Promotions:

Discount vouchers or promotional codes available on the online store must be used by you on the "Basket" page if you wish them to be deducted from the total amount of your order (excluding shipping costs).
Before definitively validating your order, please check your basket and the use of promotional codes (Always remember to check the validity date of the promotional code and the terms of use).

Vouchers or discount codes cannot be applied retroactively. We cannot manually generate discounts once you have validated and paid for your order online.

ARTICLE 4 - Payment conditions

The Buyer has the option of paying either online, by credit card or by Apple Pay.

Online payment :

By credit card : the price is payable in cash, in full on the day the order is placed by the Buyer, by secure payment method, according to the following terms: the Buyer chooses his type of card (CB, MasterCard, Visa ), enters your card number, expiration date and cryptogram (last 3 digits on the back of the card), then validates the data. He also has the option of clicking on “Cancel” to return to the previous page.

In order to guarantee the Buyer a completely secure transaction, Biscuiterie Astruc has chosen “stripe”, the bank card payment solution developed for the Shopify platform.
With this system, payment by credit card is made directly on the secure “stripe” server. At no time will the Buyer's card number be communicated to Biscuiterie Astruc. Exchanges are encrypted and secure.

Payments by credit card are debited at the time of validation of the order.

ARTICLE 5 - Deliveries

Shipping costs in FRANCE are €4.90 for colissimo at home, €4.50 for colissimo relay points and €5.50 for chronopost at home. Shipping costs in EUROPE Z1 (GERMANY (excluding Büsingen and Helgoland Island), BELGIUM, LUXEMBOURG, NETHERLANDS) are €8.90 for colissimo at home with signature and €8.00 for colissimo relay points. Shipping costs in EUROPE Z2 (AUSTRIA, SPAIN (excluding Balearic Islands, Canary Islands, Ceuta, Melilla), IRELAND, ITALY (excluding Livigno, Campione d'Italia, Vatican, Saint Martin), PORTUGAL (excluding Azores, Madeira), KINGDOM- UNI (excluding Jersey, Guemesey, Gibraltar, Isle of Man)) are €11.90 for colissimo at home with signature and €11 for colissimo relay points. The products acquired by the Buyer will be handed over to the carrier within a maximum of 5 working days, and delivered to the address indicated by the Buyer when ordering on the website.

Except in special cases or unavailability of one or more products, the products ordered will be delivered in one go. Deliveries are ensured by an independent carrier. (THE POST OFFICE)

The delivery date runs from 3 days following the date of receipt of the Buyer's order.

The Seller undertakes to make its best efforts to deliver the products ordered by the Buyer within the deadlines specified above. However, these deadlines are communicated for information purposes only and any excess may not give rise to any damages, deduction or cancellation of the order by the Buyer.

Delivery is deemed to have been made upon delivery of the products ordered by the Seller to the carrier.

In the event of a specific request from the Buyer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to additional specific invoicing, based on a quote previously accepted in writing. by the Buyer.

ARTICLE 6 - Transfer of ownership - Transfer of risks

The transfer of ownership of Biscuiterie Astruc products and the correlative transfer of the risks of loss and deterioration relating thereto, will be carried out upon acceptance of the order by Biscuiterie Astruc, materializing the agreement of the parties on the thing and on the price and regardless of the date of payment and delivery. The products therefore travel at the risk of the Buyer who may, in the event of damage, make any claims to the carrier under the legal and regulatory conditions in force.

ARTICLE 7 - Right of withdrawal

Given the perishable nature of these food products which are, by nature, for immediate consumption, the customer does not have the right of withdrawal. Once your order has been validated, it becomes firm and irrevocable in accordance with the legal provisions excluding the exercise of the right of withdrawal in matters of distance selling of perishable products (Article L.121.20.23° of the Consumer Code)

ARTICLE 8 - Responsibility of the Seller - Guarantee

ARTICLE 9 - Information Technology and Freedoms

Pursuant to Law 78-17 of January 6, 1978, it is recalled that the personal data requested from the Buyer are necessary for the processing of their order and the preparation of invoices, in particular.
